Board of Adjustment
About the Board
The Board of Zoning Adjustment is a quasi-judicial board of five residents, appointed by the Board of Aldermen, established to hear and decide appeals and consider requests for variances from the city's zoning regulations.
Standards of approval
Applicants are strongly encouraged to assess whether their appeal or variance request will meet the state & local legal standards for approval, as described in Section 26-3 (D.) of the Municipal Code, prior to submittal of their application.
Appeals. Appeals may be heard where it is alleged an error has occurred in a decision or determination made by the Director of Public Works in the enforcement of the zoning regulations.
Variances. A variance may be requested where, owing to special conditions, a literal enforcement of the zoning regulations will result in practical difficulties or unnecessary hardship. The applicant must show that their property was acquired in good faith and where by reason of exceptional narrowness, shallowness, or shape of their specific piece of property, or where by reason or exceptional circumstances, that the strict application of the zoning regulations actually prohibit the practical use of their property in the manner similar to that of other property in the zoning district where it is located.
A request for a variance may be granted upon a finding of the Board of Adjustment that all of the following conditions have been met:
- The variance requested arises from such condition which is unique to the property in question and which is not ordinarily found in the same zone or district and is not created by an action or actions of the property owner or applicant.
- That literal interpretation of the provisions of this chapter would deprive the applicant of rights commonly enjoyed by other properties in the same district under the terms of this chapter.
- That the special conditions and circumstances do not result from the actions of the applicant.
- That granting the variance requested will not confer on the applicant any special privilege that is denied by this chapter to other land, structures, or buildings in the same district.
Meetings & Application Deadlines
The City of Crestwood Board of Zoning Adjustment meetings are held on the 2nd Thursday of the month at 7:00pm, unless noted otherwise.
